Legal Updates Regarding Carry Concealed Weapons

August 21 2025

As the result of a permanent injunction issued by the United States District Court for the Southern District Court of California in Hoffman et al. v. Rob Bonta, members of the Firearms Policy Coalition (FPC), who are not residents of California, are permitted to apply for a California CCW license.

Note: This order does not otherwise affect the preliminary injunction issued on January 22, 2025 in California Rifle & Pistol Association, Inc., et al. v. Los Angeles County Sheriff's Department, et al.

July 1, 2025

On July 1, 2025, in Hoffman, et al., v. Rob Bonta, the U.S. District Court for the Southern District of California held California's nonresident ban to be unconstitutional. The parties were given 30 days to submit a proposed order regarding implementation of the court's order.

April 22, 2025

As the result of a preliminary injunction issued by the U.S. District Court for the Central District of California on January 22, 2025, in California Rifle & Pistol Association, Inc., et al. v. Los Angeles County Sheriff's Department, et al., (the "Order") residents of U.S. states and territories other than California are eligible to apply for a California CCW license under Penal Code section 26150 through 26235, beginning April 22, 2025. Under the Order, the applicant must be a member of one of the plaintiff organizations (the California Rifle & Pistol Association, Gun Owners of America, Gun Owners of California, or Second Amendment Foundation).

January 23, 2025

On September 6, 2024, the U.S. Court of Appeals for the Ninth Circuit issued its opinion in the combined cases of May v. Bonta, Carralero v. Bonta, and Wolford v. Lopez. The panel addressed the district court's preliminary injunction of several provisions of "sensitive places" in Penal Code § 26230. This is effective January 23, 2025.

September 20, 2024

On September 20, 2024, the plaintiffs in May, et al. v. Bonta, et al., filed a petition for rehearing en banc, preventing the Ninth Circuit's September 6, 2024 opinion from taking effect. The U.S. District Court's December 20, 2023 order remains in effect pending action by the Ninth Circuit on plaintiffs petition for rehearing en banc. 

September 6, 2024

On September 6, 2024, the U.S. Court of Appeals for the Ninth Circuit issued its opinion in the combined cases of May v. Bonta, Carralero v. Bonta, and Wolford v. Lopez. The panel affirmed in part and reversed in large part the district court's preliminary injunction of several provisions of Hawaii and California laws that prohibit the carry of firearms at "sensitive places."

August 20, 2024

On August 20, 2024, the U.S. District Court for the Central District of California issued an order in California Rifle & Pistol Association v. Los Angeles County Sheriff's Department prohibiting enforcement of the California residency requirement. The parties were given 30 days to submit a proposed order regarding implementation of the court's order.

January 6, 2024

On January 6, 2024, the U.S. Court of Appeals for the Ninth Circuit dissolved the administrative stay issued on December 30, 2023. The district court order issued on December 20 is reinstated. The court's order bans enforcement of the following SB 2 Penal Code sections: 26230(a)(7-13); 26230(a)(15-17); 26230(a)(19-20); 26230(a)(22-23); 26230(a)(26); and 26230 as it pertains to parking areas. The court's order only modifies the identified sections and will remain in effect until further order from the court.

January 1, 2024

California Senate Bill 2 (SB 2) goes into effect on January 1, 2024. SB 2 establishes new statewide standards for issuing concealed weapons licenses (CCW) and public carry regulations by amending and adding multiple Penal Code sections relating to firearms.

December 30, 2023

On December 30, 2023, the U.S. Court of Appeals for the Ninth Circuit issued an administrative stay of the District Court's order. As such, all provisions of SB 2, including all "sensitive places" provisions, are in effect as of January 1, 2024, and will remain in effect until further court order.

December 20, 2023

On December 20, 2023, the U.S. District Court for the Central District of California issued an order in two companion cases, May v. Bonta and Carralero v. Bonta. The court order prohibited enforcement of specific SB 2 provisions that forbid the carrying of concealed weapons in certain "sensitive places".
